2. Accepting these terms
By downloading, accessing, or using JollyPod, you agree to these terms and the Privacy Policy. If you do not agree, do not use the service. You must be legally capable of entering into this agreement or have permission from a parent or legal guardian.
Apple’s terms also apply to downloads, TestFlight builds, purchases, and subscriptions made through Apple services.
3. What JollyPod provides
JollyPod is a podcast player for discovering, organising, downloading, and playing audio and video podcast content and compatible files. Features can vary by device, operating-system version, region, podcast feed, beta status, and subscription level.
Beta versions may contain unfinished features, change without notice, or stop working when a TestFlight build expires.
4. Free use and annual subscription
JollyPod can be used for free and may offer an optional paid annual subscription. The app shows the applicable price, billing period, included benefits, and any trial conditions before you confirm a purchase.
Billing and renewal
Subscriptions purchased through Apple are charged to your Apple account. Unless cancelled at least 24 hours before the end of the current period, an annual subscription may renew automatically and your account may be charged for the next period under Apple’s applicable rules.
Cancellation and refunds
You can manage or cancel a subscription in your Apple account settings. Deleting JollyPod does not cancel a subscription. Refund requests and statutory withdrawal rights are handled subject to Apple’s procedures and any mandatory consumer-protection law that applies to you.
Changes
Subscription features or prices may change. Any price change will be communicated and applied in accordance with Apple’s requirements and applicable law.
5. Acceptable use
You may use JollyPod for lawful personal purposes. You must not misuse the service, interfere with its security or operation, attempt unauthorised access, distribute malicious code, or use it in a way that infringes another person’s rights or applicable law.
You are responsible for the files, feed addresses, and other material you choose to import or sideload, including having any rights or permissions required for that use.
6. Podcasts and third-party services
Podcast episodes, artwork, descriptions, feeds, and media are provided by third-party publishers. JollyPod does not control or endorse that content and is not responsible for its accuracy, legality, quality, availability, or continued hosting. Publishers may change or remove content at any time.
Links and connections to Apple, podcast directories, publishers, media hosts, and other third-party services are governed by those parties’ terms and policies.
7. JollyPod intellectual property
JollyPod, its design, branding, and original software are owned by Simon Zryd or the relevant licensors. Subject to these terms and applicable store rules, you receive a limited, personal, non-exclusive, non-transferable, and revocable right to use the app. No ownership rights are transferred to you.
8. Availability and changes
The service is provided on an “as available” basis. JollyPod may be updated, changed, suspended, or discontinued, including to improve the app, respond to technical or legal requirements, or maintain security. Reasonable efforts will be made to avoid unnecessary disruption, but uninterrupted or error-free operation is not guaranteed.
9. Warranties and liability
To the fullest extent permitted by law, no warranties are made beyond those that cannot legally be excluded. JollyPod is not responsible for losses caused by third-party podcast content, publisher outages, incompatible feeds or files, network availability, device settings, or events outside reasonable control.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct or gross negligence and any mandatory consumer rights.
10. Ending your use
You may stop using JollyPod at any time. Access may be limited or terminated if you materially breach these terms, misuse the service, create a security risk, or if operation of the service becomes unlawful. Ending use does not automatically cancel an Apple subscription; manage it separately in your Apple account.
11. Governing law and changes
These terms are governed by Swiss law, without prejudice to mandatory consumer-protection rights that apply in your country of residence. The competent courts in Switzerland have jurisdiction where legally permitted.
These terms may be updated to reflect changes to JollyPod, Apple’s requirements, or applicable law. The effective date at the top identifies the current version. Material changes will be communicated through an appropriate channel.
