2. Your agreement and Apple’s terms
These are additional terms between you and Simon Zryd for JollyPod. By downloading, purchasing, accessing, or using JollyPod, you agree to these terms and the Privacy Policy. If you do not agree, do not use the app or website.
Apple’s Standard Licensed Application End User License Agreement applies to your licence to use the app unless Apple displays another licence for JollyPod. Apple’s Media Services Terms and applicable App Store or TestFlight rules govern downloads, store billing, subscriptions, and Apple services. Mandatory law prevails if it gives you rights that these documents cannot limit.
You must be legally capable of entering into this agreement. If not, a parent or legal guardian must review and agree to these terms for you.
3. What JollyPod provides
JollyPod is a podcast player for discovering, following, organising, downloading, playing, and sharing audio and video podcasts and compatible files. It includes queue, inbox, history, chapter, per-podcast setting, OPML, download, widget, Apple Watch, iPad, and Mac features where supported.
If you create a public JollyPod share link, anyone with the link can view the submitted episode or podcast display metadata. Opening the link does not itself start playback, follow a podcast, or change a queue or library. A link remains available for 30 days after its most recent deliberate creation request and then expires automatically.
Features can vary by device, operating-system version, region, podcast feed, beta status, and subscription level. JollyPod does not host third-party podcast media. An internet connection is required for search, feed updates, streaming, purchases, and iCloud sync; previously downloaded media can be played offline where supported.
TestFlight and other beta versions may contain unfinished features, errors, or compatibility problems and can stop working when a build expires. Important consumer rights still apply to paid digital services where the law says they do.
4. Free plan and JollyPod Unlimited
The free plan lets you follow up to 10 podcasts. OPML imports are limited by the number of free podcast slots remaining. Playback and other available free features can be used without a JollyPod account.
The optional annual subscription, currently called JollyPod Unlimited, removes the followed-podcast and OPML import limit while the subscription is active. It is intended to work on supported iPhone, iPad, Mac, and Apple Watch versions linked to your Apple Account. Family Sharing is included where it is available, configured for the subscription, and supported by Apple.
The purchase screen shows the current product name, price, billing period, included benefits, and any introductory offer before you confirm. Promotional or gift codes are subject to their stated conditions, availability, region, and Apple’s redemption rules.
5. Billing, automatic renewal, and price changes
Apple processes the purchase and charges the payment method connected to your Apple Account. The annual subscription renews automatically each year until you cancel it. The price and any applicable taxes are shown by Apple before purchase.
You can manage or cancel the subscription in your Apple Account subscription settings. Cancel before the renewal date shown by Apple to avoid the next charge. Deleting JollyPod does not cancel a subscription. After cancellation, paid access normally continues until the end of the already-paid period.
Apple provides purchase restoration and subscription status. If a price changes, Apple will notify you and request consent where required. If you do not accept a required price increase, the subscription will not renew at the new price.
6. Cancellation, withdrawal, and refunds
Cancellation stops a future renewal; it does not automatically reverse a completed charge. Apple handles App Store refund requests through its applicable process, including Report a Problem.
If mandatory consumer law gives you a right to withdraw from a digital-content or digital-service contract, that right remains available. In the EEA, this is generally 14 days for distance contracts, subject to legal exceptions. For a service started at your express request during that period, the law may allow a proportionate charge for what was already supplied. A withdrawal right for immediately supplied digital content can be lost only where the legal requirements for prior express consent and acknowledgement are met. Nothing in these terms asks you to waive a right without the consent and information required by law.
Refunds, price reductions, or termination rights required because a paid digital service is not in conformity remain unaffected by Apple’s voluntary refund rules.
7. Consumer guarantees, remedies, and updates
Mandatory consumer guarantees and statutory warranty rights are not excluded. Where applicable law requires it, you may be entitled to have a problem corrected, receive a proportionate price reduction, terminate the contract, or receive a refund if JollyPod does not conform to the contract and the issue is not properly resolved.
JollyPod may provide updates needed for security, compatibility, and continued conformity. You should install free updates within a reasonable time after being informed of them. JollyPod is not responsible for a problem caused solely by failing to install a necessary update after clear notice, where the law permits that result and the installation instructions were adequate.
8. Acceptable use and your files
You may use JollyPod for lawful personal purposes. You must not misuse the app, website, or public share-link service; submit unlawful, malicious, deceptive, or rights-infringing metadata; interfere with security or operation; attempt unauthorised access; distribute malicious code; circumvent subscription checks; or use JollyPod in a way that infringes another person’s rights or applicable law.
You are responsible for feed addresses, OPML files, MP3s, and other material you choose to import or sideload, including having the rights or permissions required to use that material. JollyPod does not claim ownership of your imported files.
9. Podcasts and third-party services
Podcast episodes, artwork, descriptions, feeds, and media are provided by third-party publishers. JollyPod does not control or endorse them and cannot guarantee their accuracy, legality, quality, accessibility, availability, or continued hosting. Publishers can change, restrict, or remove content at any time.
Apple, podcast directories, RSS publishers, media hosts, websites opened from show notes, and other third-party services have their own terms and policies. JollyPod is not responsible for a third party’s service, except where mandatory law provides otherwise.
10. Licence and intellectual property
JollyPod, its branding, design, website, and original software are owned by Simon Zryd or the relevant licensors. Your licence to use the app is governed by Apple’s applicable end-user licence and Usage Rules. No ownership right in JollyPod is transferred to you.
Third-party podcast content remains the property of its publishers and licensors. Any open-source component remains subject to its own licence.
11. Availability, maintenance, and changes
JollyPod depends on Apple platforms and independent podcast services, so uninterrupted or error-free operation cannot be promised. Temporary interruption may be necessary for maintenance, security, legal compliance, provider outages, or events outside reasonable control.
Features may be improved, replaced, or removed for technical, security, legal, or product reasons. Where a change materially and negatively affects a paid digital service beyond what is necessary to keep it conforming, reasonable advance notice and any cancellation, termination, or refund rights required by law will be provided.
12. Support, warranties, and liability
Simon Zryd, not Apple, is responsible for JollyPod support and maintenance, except for services Apple itself provides. Support is available at hello@jollypod.app. No specific response or resolution time is promised.
JollyPod is provided with the skill and care required by applicable law. Beyond mandatory rights, no guarantee is made that every feed or file will remain compatible, that every third-party episode will stay available, or that the service will always be uninterrupted.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, fraud, or mandatory consumer rights. Subject to those rules, Simon Zryd is not responsible for losses caused solely by third-party content or outages, incompatible feeds or files, user-controlled device settings, unlawful imported material, or events outside reasonable control.
13. Ending your use
You may stop using JollyPod at any time. You can clear local data, delete iCloud data through JollyPod’s controls, and remove the app. These actions are separate from subscription cancellation and do not immediately remove an already-created public share link, which expires automatically after its 30-day retention period. You can send the complete link to hello@jollypod.app to request earlier review or deletion.
Access may be restricted or ended if you materially breach these terms, misuse JollyPod, create a serious security or legal risk, or if continued operation becomes unlawful. Where required, you will receive notice and a reasonable opportunity to correct the issue unless immediate action is necessary. Statutory rights concerning paid periods, refunds, and retained data remain unaffected.
14. Governing law, disputes, and changes to these terms
These terms are governed by Swiss law. If you are a consumer, this choice does not remove mandatory protections or access to courts provided by the law of your country of residence. Courts in Switzerland have jurisdiction only where that is legally permitted.
Please contact hello@jollypod.app first so a concern can be resolved directly. You may also use any consumer authority, court, or dispute process available under mandatory law.
These terms may be updated for legal, security, provider, or service changes. Material changes will be communicated through the app, website, or another appropriate channel before they take effect where required. Changes do not retroactively reduce rights already acquired. If one provision is invalid, the remaining provisions continue to apply.
